ФОРМУВАННЯ СУСПІЛЬНОЇ ПРАВОСВІДОМОСТІ У МОДЕРНУ ДОБУ

Abstract

У статті здійснюється соціально-філософське дослідження процесу формування суспільної правосвідомості у модерну добу. Обґрунтовується теза, що процес формування модерної правосвідомості носив поступальний характер, пов’язаний зі становленням права. Перша фаза формування правової свідомості була пов’язана з правовою лібералізацією, яка полягала у забезпеченні індивідуальних прав і свобод. Друга фаза пов’язана з політичною лібералізацією, або демократизацією, суспільства, що закріплювала правову фазу та забезпечувала кожному індивіду право на дотримання належних правових процедур, а також доступ до прав. Третя фаза ґрунтувалася на економічній або ринковій лібералізації, яка сприяла свободному економічному розвитку на підставі правового і політичного лібералізму.
